Refugee protection

The following sections contain information on the most important international treaties and agreements of which Indonesia is signatory, as well as national legislation relevant to the protection of refugees.
Indonesia is not a signatory to the 1951 Convention Relating to the Status of Refugees, nor its 1967 Protocol. As such, the UNHCR assesses an asylum seeker’s claim for international protection through their established individual refugee status determination (RSD) procedure.
While Indonesia is not party to the 1951 Convention, 1967 Protocol, or similar protection instruments it has a long tradition of allowing access to and hosting refugees. Indonesia has enacted a comprehensive national refugee law, signed into presidential regulation in December 2016. The law provides access and temporary protection to refugees in the country until longer-term solutions are found.
Presidential Regulation No. 96 and the Ministry of Home Regulation No. 108 both serve as the national legal basis for refugee children to attain birth certificates.

YLBHI provides legal assistance in cooperation with Jakarta Legal Aid Institution and Human Rights Working Groups. YLBHI assists refugees in obtaining refugee status certificates from the UNHCR during the refugee status determination (RSD) procedure.

“SUAKA” is the Bahasa Indonesia word for asylum. SUAKA is an association for the protection of refugee rights. We are a network of voluntary civil society, consisting of individuals and organizations that aim to work for the protection and advancement of the human rights of refugees and asylum seekers in Indonesia.
Growing from awareness of the situation of vulnerable asylum seekers and refugees in Indonesia, several civil society organizations and caring individuals gathered in October 2012 and committed to assisting refugees and asylum seekers. SUAKA, since May 2018 has become a legal entity in the form of an Association based on the Decree of the Ministry of Law and Human Rights.

HRWG was established in 2003 by a conference of Indonesian human rights organisations. Its main purpose is to coordinate effective international human rights advocacy towards various UN human rights mechanisms, regional human rights mechanisms, and ensure that standards ratified by the Indonesian government are actually implemented.
HRWG’s activities include media advocacy, lobbying relevant governmental institutions, providing training and capacity building, and monitoring and advocacy.

The JRS began their work in Indonesia in 1980, advocating for the rights of the forcibly displaced. JRS’ activities now include providing assistance through the Displacement Prevention Programme, which consists of a combination of peace education, DRR, IDP mapping, advocacy on displacement issues, and emergency responses to the displaced and refugees.

Roshan Learning Center is a community-driven initiative serving asylum seekers and refugees in Jakarta, Indonesia. Roshan focuses on refugee education in Jakarta and does this by providing learning experiences for children and youth while also empowering parents and other adults through English classes and other practical and enriching activities.
