Refugee protection

The following sections contain information on the most important international treaties and agreements of which Kazakhstan is signatory, as well as national legislation relevant to the protection of refugees.

Kazakhstan acceded to the 1951 Refugee Convention Relating to the Status of Refugees and its 1967 Protocol in 1999. Although Kazakhstan has not yet acceded to the 1954 Convention Relating to the Status of Stateless Persons nor the 1961 Convention on the Reduction of Statelessness, the UNHCR actively promotes its implementation by strengthening legal and administrative frameworks aimed at identification, registration, and protection of stateless persons. 

Following the entry into force of the National Law of Refugees in January 2010, the Government of Kazakhstan assumed the full responsibility of refugee status determination (RSD). Kazakhstan’s Migration Police Department are its territorial offices are responsible for registering and documenting stateless persons arriving in Kazakhstan.

Kazakhstan International Bureau for Human Rights and the Rule of Law implements the project on legal assistance to refugees in cooperation with UNHCR in Kazakhstan. Kazakhstan International Bureau for Human Rights and the Rule of Law provides free legal consultations in the Bureau’s headquarters in Almaty, conducts trainings in human rights for law professionals and students, operates an assistance program for refugees, and maintains its Legal Defense Center. The Bureau analyzes legislation regarding refugees and asylum in Kazakhstan, offers free legal aid, and provides material assistance in exceptional cases. They have nine branches and one representative, all of which provide free legal aid.
