Legal Framework

Section 435 of the Grenada Criminal Code lists ‘unnatural crime’ committed by way of sexual intercourse per anum (anal penetration), as an offence. Such offence is punishable by imprisonment for ten years. The Criminal Code does not specify the ‘penetrating’ object. The offence can be committed by, (1) male person with/to male person and/or (2) male person with/to female. Two female persons cannot commit the offence.

According to the Grenadian Voice, in the criminal code, sodomy is referred to as a ‘crime against nature’ or as a copulation against the ‘order of nature.’ According to a 2003 report by the Immigration and Refugee Board of Canada, ignorance and violence surround homosexuality in Grenada. On the matter, Rev. Osbert James speaking to the Grenadian Voice said ‘the court does not criminalise orientation it criminalises the act.”
