Refugee protection

The following sections contain information on the most important international treaties and agreements of which Yemen is signatory, as well as national legislation relevant to the protection of refugees.

Yemen is both a party to the 1951 Convention relating to the Status of Refugees and to its 1967 Protocol. The rights codified in the 1951 Convention include the principles such as non-refoulement (Article 33), and rights to services such as education (Article 22), freedom of movement (Article 26 and 31(2)), and decent work (Articles 17, 19, and 24). Yemen, however, has not yet accepted the 1961 Convention on the Reduction of Statelessness nor its additional UN Stateless Conventions. 

Despite Yemen’s signatory status of the 1951 Convention Relating to the Status of Refugees and 1967 Protocol, it has yet to incorporate its obligations into national, region-specific legislation. In the absence of such legislation, the legal status of asylum seekers and refugees is determined by a patchwork of decrees and provisions, including the Republican Decree N° 47 of 1991. However, since 1990, Yemen’s National Sub-Committee on Refugee Affairs and the Bureau of Refugee Affairs automatically recognizes Somali asylum seekers as refugees. Non-Somali asylum seekers must undergo the UNHCR status determination procedure.

The NRC’s Information, Counselling and Legal Assistance Team (ICLA) provides support and programming to help people access critical legal and civil documentation. With a particular focus on women and children, the NRC provides both legal counselling and legal assistance, as well as training related to Housing, Land and Property rights. The NRC additionally delivers programmes that aim at reducing protection risks including individual protection services, psychological first aid, and cash and voucher assistance.

The UNHCR in Yemen has several locations, including the UNHCR Chief of Mission in Kharaz, the UNHCR Representative in Yemen, and the UNHCR Head of Sub-Office. The UNCHR provides legal and cash support, pyscho-social support, and a range of protection services for the prevention of gender-based violence with specific interventions focusing on women and children.

CSSW is a NGO and non-profit who partners with the UNHCR to provide social and material support to refugees, particularly those living in rural communities, as well as vulnerable youth, women, and children. Some services include food security, water and environmental sanitation, education, and protection and shelter.

INTERSOS has been in Yemen since 2008, providing integrated health and nutrition programmes, health facility support, and protection to vulnerable people in need. INTERSOS works primarily with  refugees, asylum seekers, and migrants, with a particular focus on women, girls, and children who are in need of gender-based violence and child protection.
