Refugee protection

The following sections contain information on the most important international treaties and agreements of which Tanzania is signatory, as well as national legislation relevant to the protection of refugees.
Tanzania is party to the 1951 Convention Relating to the Status of Refugees and to its 1967 Protocol. The country acceded to the 1951 Convention without any reservation, however, it entered a reservation regarding Article IV of the 1967 Protocol. Tanzania is also a State Party to the 1969 OAU Convention Governing the Specific Aspects of Refugee Problems in Africa. It is, however, not yet a party to the 1954 Convention Relating to the Status of Stateless Persons nor the 1961 Convention on the Reduction of Statelessness.
The status and treatment of asylum seekers and refugees in Tanzania is governed by the Refugees Act of 1998 and the 2003 Refugees Policy, implemented by the Ministry of Home Affairs through the Refugee Services Department. Refugee Status Determination (RSD) is conducted by the National Eligibility Committee also established under the 1998 Refugees Act.

LHRC is Tanzania’s human rights advocacy organization. Through a dedicated and trained team of over 200 human rights monitors and paralegals, LHRC collects, analyzes, and responds to violations. LHRC’s advocacy and strategic litigation programme is highly involved in the national law-making process, analyzing bills from the parliament and various ministries. It also works closely with Legal Aid Clinics and media outlets to advise on strategic litigation methods.

The Inter Africa Committee Tanzania Dodoma Chapter was formed in order to initiate and carry out programmes to combat traditional practices that are harmful to both society and the health of women and children. They conduct training on the negative effects of FGM/C and the urgency to prevent and abolish it in order to improve women’s and children’s health. NAFGEM Tanzania is a network of members working towards the elimination of FGM/C, child marriages, and other forms of violence against women and the child. They raise awareness on FGM/C and gender based violence through sensitization and awareness creation, as well as promoting empowerment and education of women and children. NAFGEM also provides safe shelter spaces in Moshi, Lekrimuni and Orkesmet to facilitate services to survivors of FGM/C and gender based violence.

Refugee Self Reliance Program was created to respond to the needs of refugees living in urban areas and outside camp structures. Refugee Self Reliance Program attempts to intervene on behalf of these refugees through providing social assistance, offering evening classes for urban refugee children not attending school, and engages in development projects including tailoring micro-projects.

TCRS focuses on the reduction of poverty and human suffering through the empowerment of vulnerable and displaced communities in Tanzania. TCRS runs a refugee project in the Kibondo district which is responsible for management, water and sanitation, food and non-food distribution, and other similar services. TCRS is also active in national advocacy on behalf of refugees in Tanzania, particularly in lobbying for the freedom of movement of refugees outside camps from where they are currently confined .
