Refugee protection

The following sections contain information on the most important international treaties and agreements of which Luxembourg is signatory, as well as national legislation relevant to the protection of refugees.

Luxembourg is a party to both the 1951 Convention relating to the Status of Refugees and to its 1967 Protocol. It has also accepted the UN Statelessness Conventions. 

Regionally, Luxembourg is a member of the European Union (EU). As such, it is subject to the EU framework on refugee protection, which is based upon the Schengen Borders Code (Regulation (EU) 2016/399), the Dubin Regulation (Regulation (EU) No 604/2013) and the Asylum Procedures Directive (Directive 2013/32/EU). 

Luxembourg’s refugee protection is based on the country’s Loi du 18 décembre 2015 relative à la protection internationale et à la protection temporaire (asylum procedure law) and on the Loi du 18 décembre 2015 relative à l’accueil des demandeurs de protection internationale et de protection temporaire (law on the reception conditions of asylum-seekers). Also, the Ministry of Foreign and European Affairs is responsible for processing the applications for asylum.

Their goal is that all refugees and migrants should be treated with the dignity and respect that everyone is entitled, and our immigration and asylum systems should be fair and effective. They attempt to achieve this goal in a number of ways, including carrying out research into aspects of immigration and asylum policy and practice, developing proposals for improving those policies and practices and then promoting our proposals with the government, MPs and other opinion formers, and intervening in key court cases to ensure asylum decisions are made using the best available evidence on human rights conditions.

The Red Cross in Luxembourg provides services in housing, medical care, and social assistance. Also, the Migrants and Refugees Service (Service Migrants et Réfugiés, SMR) informs and supports migrants, more particularly applicants for international protection (Demandeurs de Protection Internationale – DPI), throughout their stay in Luxembourg.
