Refugee protection

The following sections contain information on the most important international treaties and agreements of which Libya is signatory, as well as national legislation relevant to the protection of refugees.
Libya has not ratified and is not a party to the 1951 Convention relating to the Status of Refugees or its Protocol. It has however ratified the 1969 Convention governing the Specific Aspects of Refugee Problems in Africa (OAU Convention), which adopts the same definition of a refugee as the 1951 Convention and its 1967 Protocol.
Libya has yet to implement the OAU Convention through the adoption of asylum-related legislation or procedures. Furtermore, Libyan law considers asylum-seekers and refugees as illegal migrants and arbitrary detention in lifethreatening conditions is widespread, with frequent allegations of torture, or other forms of cruel, inhuman or degrading treatment.

‘We are a Libyan and international independent non-governmental organisation. We work on and in Libya with a growing network of lawyers, activists and grassroots communities across and outside the country.’
‘We see ourselves not merely as observers but as active participants, during Libya’s transition and beyond, where justice is an integral and continuous part of the process. Our work is rooted in a rights-based and victim-centred approach: we believe that all engagement and policies must be founded on a framework of human rights and ensure that individuals and communities can participate fully as a fundamental part of leading dignified lives.’
