Refugee protection

The following sections contain information on the most important international treaties and agreements of which Kyrgyzstan is signatory, as well as national legislation relevant to the protection of refugees.

In 1996, Kyrgyzstan ratified both the 1951 Convention relating to the Status of Refugees and its 1967 Protocol.

However, Kyrgyzstan is not a party to the 1954 Convention relating to the Status of Stateless Persons, or the 1961 Convention on the Reduction of Statelessness. Nevertheless, Kyrgyzstan has international obligations to protect the right to a nationality and protect the rights of stateless persons on the basis of other UN and regional treaties to which it is a party, such as the International Covenant on Civil and Political Rights (Art. 24.3), the International Covenant on Economic, Social and Cultural Rights (Arts. 2.2 and 2.3), the Convention on the Rights of the Child and its first and second optional protocols (Arts. 2, 3, 7 and 8).

In 1993, Kyrgyzstan established the Law on the Legal Status of Foreign Citizens. Then, in 2002, they established the foundation for their asylum system, passing the Refugee Law. Then, in 2007, they established the Law on state guarantees for ethnic Kyrgyz migrating to the Kyrgyz Republic and the Law on Citizenship. Finally, in 2012, the government passed the Law No.15 to Amend and Supplement the Law on Refugees.

The Legal Aid Clinic ”Adilet” implements projects which are intended to protect human rights and freedoms in the Kyrgyz Republic. The Clinic has highly qualified legal staff with practical experience in protection field. The organisation provides pro bono legal assistance to vulnerable groups of the population (amongst others, refugees, asylum seekers and stateless persons) and tries to raise its legal culture; monitors the observing of citizens’ rights by the government bodies; tries to improve the legislative base on issues touched by the projects it implements; provides training on advocate practical skills to students; and tries to rise awareness on the issues touched by its projects. The Legal Aid Clinic ”Adilet” is an implementing partner of UNHCR.
