Refugee protection

The following sections contain information on the most important international treaties and agreements of which Honduras is signatory, as well as national legislation relevant to the protection of refugees.

Honduras is a party to both the 1951 Convention relating to the Status of Refugees and to its 1967 Protocol (with reservations to Articles 7, 17, and 34 of the Convention). It has also accepted the UN Statelessness Conventions. 

Regionally, it applies the refugee definition according to the Cartagena Declaration. 

Honduras’ national framework of refugee protection is based on the country’s 2004 Migration Law, which establishes the right to seek asylum. Its regulatory laws also define the role of multiple government agencies and institutions in the protection of migrants and asylum seekers, such as the National Institute for Migration and Migration Officers.

CIPRODEH is a human rights organisation, which has a free legal assistance programme for asylum seekers, refugees and foreign nationals that wish to regularise their migratory status and have limited economic resources.

CONADEH is the institution of the Honduran State that guarantees the respect and promotion of the human dignity of all inhabitants and migrants, ensuring the progressive effectiveness and adequate protection of their human rights and fundamental freedoms. It is also tasked with providing legal assistance for the population. There are multiple locations, which can be found here.

UNHCR in Honduras supports the Government of Honduras in strengthening protection for refugees and asylum seekers. UNHCR works primarily with refugees and asylum seekers, persons in transit with international protection needs, deportees with international protection needs and internally displaced persons at high risk of violence. It provides legal assistance to asylum seekers.

The Center for Gender & Refugee Studies (CGRS) has resources for women seeking asylum on account of domestic violence, including country conditions information on DV in Honduras and an expert declaration on DV in Honduras. If you would like to receive a copy of this information, please fill out a request for information on our website and we will respond shortly. They provide all resources at no cost. They have country conditions information and advisory materials for a number of other countries and topics, especially information regarding gender-based violence, persecution of LGBT individuals, and children. They cover anywhere and everywhere, although their resources regarding domestic violence and violence against women in Mexico and Central America are the most extensive. They have information packets for over 100 countries and with 4-6 weeks’ notice are happy to produce new packets for specific cases concerning gender, LGBT, or children’s issues. In addition to those packets, they have general expert declarations regarding domestic violence in Mexico, violence against indigenous women in Mexico, domestic violence in Guatemala, Honduras, El Salvador, violence against women generally in El Salvador, one on FGC generally, and one on incest.
