Refugee protection

The following sections contain information on the most important international treaties and agreements of which China is signatory, as well as national legislation relevant to the protection of refugees.
The People’s Republic of China became a State party to the 1951 Convention Relating to the Status of Refugees and its 1967 Protocol in 1982. China is not, however, a State party to either the 1954 Convention Relating to the Status of Stateless Persons or the 1961 Convention on the Reduction of Statelessness. Nonetheless, China has acceded to several key human rights treaties which govern and inform the treatment of children, and recognize civil, political, economic, social, and cultural rights.
In 2012, the Standing Committee of China’s National People’s Congress adopted a new Administration Law on Entry and Exit which, for the first time, added provisions on the treatment of refugees into domestic law (Art. 46). However, China has yet to adopt national asylum legislation with UNHCR technical support, as well as establish a responsible government institution to oversee refugee matters.

UNHCR Beijing focuses on protection needs, including registering asylum-seekers, refugee status determination claims, and durable solutions. Mr. Andrew Lillis, similarly, is a practising lawyer with experience representing refugees with UNHCR. He is prepared to be contacted regarding pro bono asylum cases and may be able to assist with Country of Origin information.
