Refugee protection

The following sections contain information on the most important international treaties and agreements of which Chad is signatory, as well as national legislation relevant to the protection of refugees.

Chad is signatory to the 1951 Refugee Convention Relating to the Status of Refugees and the 1967 Protocol. In 1981, Chad additionally ratified the 1969 OAU Refugee Convention Governing the Specific Aspects of Refugee Problems in Africa. Chad is not, however, signatory to either of the UN Conventions on Stateless, including the 1954 Convention Relating to the Status of Stateless Persons and the 1961 Convention on the Reduction of Statelessness.

In late 2020, Chad adopted its first-ever asylum law, which enhanced protections for the current 480,000 refugees currently hosted in the country. The law ensures refugees and asylum seekers fundamental protections including freedom of movement, the right to work and access to education, healthcare, and justice. The law also guided the establishment of an efficient national asylum system, which is being pursued under the Asylum Capacity Support Group. Association des Femmes Juristes du Tchad is an organisation that works to improve socio-legal conditions for and defend the rights of women and children in Chad. Association des Femmes Juristes du Tchad focuses on training and the support of women in peace building, including mediation, reconciliation, and dispute resolution techniques as well as funding for legal support.

AJPNV employs a comprehensive mechanism by providing advocacy, monitoring government adherence to human rights violations, and providing litigation and rehabilitation support through medical, psychosocial, and legal support. AJPNV intervenes by covering the cost of lawyers, courts, translation, and legal proceedings in addition to the provision of social services aimed to reduce any sense of marginalisation and facilitate access to housing, healthcare, education, and training.

APLFT provides legal service and general access to justice in Chad. APLFT works to improve respect of human rights and good governance through the training of citizens, denunciation of all human rights violations, and the defence of citizens when their rights are violated.

PILC offers free legal services to all people experiencing poverty, but gives particular priority to women and children. A person experiencing destitute according to the PILC is someone without fixed resources or justifying a source of income equal to or below the minimum guaranteed interprofessional salary. A person who is confronted with problems several times can benefit as many times as necessary from the legal services provided by the PILC.

The CRF was initiated in April 2007 by a group of people in Santa Barbara, CA, USA, who were dedicated to improving the lives and prospects of people in south Chad, with particular focus on the 70,000 refugees from the Central African Republican living in camps outside of Goré, Maro, and Haraze. CRF has funded projects in health, recreation, education and housing.

CRS in Chad provides social services to refugees in Chad. Some services include education, health, psychosocial, and financial support, including finding housing in southern Chad. CRS works with food-vulnerable communities and individuals wot meet their needs in emergency situations, improve access to seeds and farming tools, and reinforce resilience to climate change.

Working with refugees since 2005, HIAS Chad has focused on strengthening community-protection networks, peaceful coexistence between refugees and host communities, mental health support, implementing GBV prevention, distribution of food and non-food items and implementing perma-gardening projects. HIAS also maintains partnership with government and other humanitarian actors to provide protection and access to goods during emergency situations.
